1. This Platform has been designed to provide and manage a centralised network of Practitioner(s) (whether an individual professional or an organization) or similar institution to arrange for patients, suffering with bone & joint problems, conditions and related diseases, nonscalable, etc., an appointment for consultation with the Practitioner(s) and to provide support to such patients. The Platform provides the option to the Patient(s)/ User(s) to book an appointment for In-Clinic or Virtual Clinic consultation with the Medical Practitioners listed on the Platform and as selected by the Patient(s) as per their own choice.

2. Definitions

• ‘Appointment’ means and includes In-Clinic and/or Virtual Clinic consultation depending upon the Patient’s selection.
• ‘In-Clinic’ shall mean the place wherein the Practitioner provides Medical Services to the Patient(s) in the physical presence of the Practitioner and the Patient(s).
• “Patient Reference Number” means the unique identification number allotted to the Patient upon placing a request for appointment with any Practitioner of his choice.
• ‘Patient(s)’ refers to patient(s) or his/ her representative(s) or affiliate(s), who is/ are searching for Practitioner(s) through the Platform and/ or has/ have availed the Services provided by the Platform.
• “Personal Information” as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 [the “SPI Rules”] means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
• ‘Platform’ includes the website www.avnclinics.com as well as email communications received from patientcare@avnclinics.com / consultation@avnclinics.com / noreply@avnclinics.com / marketing@avnclinics.com, and text messages received from +91 9321270278 and +91 9819893413.
• ‘Practitioner(s)’ refers to medical practitioner(s) or health care provider(s) (whether an individual professional or an organization) or similar institution(s) wanting to be listed, or already listed, on the Platform, including designated, authorized associate(s) and representative(s) of such practitioner(s) or institution(s).
• “Sensitive Personal Data or Information” as defined under Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
• ‘Service(s)’ means provision of a centralised network of Practitioner(s) (whether an individual professional or an organization) or similar institution to arrange for patients, suffering with bone & joint problems, conditions and related diseases, nonscalable, etc., an appointment for consultation with Practitioner(s) and to provide support to such patients.
• “Usage Data” is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).
• ‘Virtual Clinic’ refers to technology-based Patient(s)’ consultation via telephone, video, devices connected over LAN, WAN, Internet, mobile or landline phones, Chat Platforms like WhatsApp, Facebook Messenger etc., or through the Mobile App or other internet based digital platforms for providing Medical Services by the Practitioner(s) or data transmission systems like Skype/ email/ fax etc.
• ‘You’ and ‘Your’ refers to the users of the Platform and includes both, the Practitioner(s) and the Patient(s).

3. Upon booking the Appointment and by clicking ‘Accept’, You agree to abide by these Terms, Terms of Use and Privacy Policy to avail the Services on the Platform.

4. Upon booking the appointment and by clicking ‘Accept’, You agree to voluntarily provide AVN Clinics with Your Personal Information and Sensitive Personal Data or Information as and when required. Please read the Privacy Policy carefully to know the type of Personal Information and Sensitive Personal Data or Information that the Company may collect. AVN Clinics is not liable for the accuracy of any Personal Information or Sensitive Personal Data or Information provided by You on the Platform.

5. To book an Appointment and to access the Services via the Platform, You must be at least 18 years old. By clicking ‘Accept’, You represent and warrant to AVN Clinics that You are at least 18 years old, that You have the right, authority, and capacity to use the Platform and the Services available on the Platform. Anyone under the age of 18 who desires to avail the Services available on the Platform may do so through their respective parent or legal guardian.

6. Upon booking the Appointment and by clicking ‘Accept’, You agree and understand that AVN Clinics is not liable for any wrong or false information and/or credential provided by the Practitioner(s).

7. You understand and agree that AVN Clinics will make best efforts to confirm the Appointments booked by the Patient(s), but AVN Clinics will not be liable for any cancellation initiated by the Practitioner(s).

8. You understand and agree that the Practitioner(s) only uses the brand name or trademark of AVN Clinics, as a part of their promotional activities, but AVN Clinics only acts as an intermediary and that AVN Clinics is not liable for any lapse/ negligence during contact or consultation between the Patient(s) and the Practitioner(s), whether affiliated with the Platform or not.

9. The Patient(s) accept and recognise that any medical opinion acquired from the Practitioner(s) affiliated to the Platform is a medical opinion solely of that/ those particular Practitioner(s) and would not be considered a consultation/ medical opinion provided by AVN Clinics.

10. AVN Clinics shall not be liable with respect to any cause of action, losses or damages, negligence arising out of or in connection with availing the Services on the Platform. For details, please refer to limitations of liability mentioned in the Terms of Use.

11. AVN Clinics shall not be liable for any advice and/or treatment and/or negligence on part of the Practitioner(s).

12. For the Appointments booked through the Platform, the Practitioner(s) shall be mentioning/ displaying their UPI/ IMPS/ other payment details and/or QR codes on their respective profiles in order to receive such payment/ fee directly from the Patient(s).

13. You understand and agree that any unsuccessful transactions are not the responsibility or liability of AVN Clinics.

14. You understand and agree that the bookings made in the Patient(s) name is non-transferable. The Patient Reference Number issued for the particular booking is also non-transferable.

15. The Appointment once confirmed (based on the date and time mentioned by the Patient(s) and accepted by the Practitioner(s)) shall be valid only for the said Appointment and the Patient(s) shall not be entitled for the same at a later date or time. Subject to Clause 17, if there is a no show by the Patient(s), the Patient(s) shall not be entitled to claim the services for the said Appointment and the Practitioner(s) shall have the right to forfeit the fees already paid for the said Appointment.

16. Upon clicking ‘Accept’, the Patient(s) agree and understand that cancellation shall be acceptable only if the Patient(s) inform AVN Clinics/ the Practitioner(s) regarding such cancellation before 24 hours from the time of the said Appointment. Upon Cancellation, the refund shall be made by the concerned Practitioner(s) with whom the Appointment was booked. The Patient(s) would have to contact the said Practitioner(s) for such refund less the cancellation charges, if any.

17. Upon entering this Platform, You agree that any information obtained by the Patient(s) from the Platform and/ or the consultation obtained by the Patient(s) from the Practitioner(s) does not lead to the creation of a doctor-patient relationship between AVN Clinics and the Patient(s).

18. All information contained in our website is the intellectual property of AVN Clinics.
